They have seen that people dont like what they will do to prefferential MM tanks. They didnt kow it would be such a shitstorm. So they change the EULA so they can change the KV5 freely, and you can only comply. They will cough you up, and they will push this through your troat. They dont want a Foche debacle anymore.
I dont think the part where you cant critisise them anymore is legal, but the part of the ''changing'' is legal. They can do whatever they want!

Do people never read the EULAs they agree to? Only when they make it into the news because one reason or another?
We have that kind of law gibberish since at least ten years now. Developers use it to protect THEIR property and to prevent random bobs from annoying or suing them when they want to fix balance issues.
The problem here is that all those rules get a quite different undertone when you have a company like WG sitting behind them...

First, the Fansite termination clause, is for fansites using WG fansite content (pictures etc.), which is protected by the WG IP. So, yes, if you are misusing said "fansite content", WG can terminate your account for that.
Second, WG NA is working as its own company, at least on the legal department part.
Third, as stated before, this is nothing new in the EULA, and termination without refund is legal (at least in Germany there are similar cases, where the game providing company won the dispute).

Error 404: Logic not found
An apt comparison would be if the car manufacturer would come over to your house and change the engine in your car for something worse without you approving of it. And then you *WOULD* have the right to compensation.
Just like in the case of the KV-5 where WG make the service you purchased (KV-5) worse than it was when you purchased it, in that case you do have the right to a full refund and disbanding of the purchase contract.

It doesn't mean fansites (very broad definition btw, is a youtube channel also a fansite?) can't be critical as long their message is based on facts. I think before this addition WG can already sue for slander but the addition to the EULA just gives them tools to shut down sites easier.
Howeverr. if you take #fochgate for instance (and other rants), from a legal point of view it could be interesting if WG would allow such vids. Then again, you have freedom of speech, so as long as you don't use any WG copyrighted material (ingame footage f.i.) i don't think WG have any chance of taking down an entire channel for that.

Just read the Steam EULA (Steam Subscriber Agreement), you don't actually own anything and Valve can terminate your account at any time:
